Terms of Service

These terms govern the use of the Lumnya app by Shopify stores. By installing or using the app you accept them on behalf of your store.
1. The service
Lumnya is an AI assistant for Shopify stores: a chat widget for your shoppers, automations (cart recovery, returns, recommendations) and an admin dashboard with analytics and AI agents. The service is provided by EMARKSS LTD, registered in England and Wales (Company No. 16181893), 82a James Carter Road, Mildenhall, United Kingdom, IP28 7DE.
2. Account and access
Access is through the store's Shopify account. You are responsible for the actions of anyone with access to your store's Shopify admin. The scopes you approve at install define what the app can access.
3. The AI — what it promises and what it doesn't
The assistant produces answers and recommendations using artificial intelligence. Despite safeguards (discount limits, approvals, confidence thresholds), the AI can make mistakes or produce inaccurate content.
You define its operating limits (maximum discount, auto-approvals, tone) and remain responsible for the commercial consequences of the settings you enable. Every AI answer to a shopper is labeled as such, and you can pause the AI at any time from settings (kill switch).
4. Billing
- All charges run exclusively through Shopify Billing and appear on your Shopify invoice.
- The current pricing (free allowance, per-use price, spend cap) is shown on the in-app Billing page before every approval.
- Usage charges never exceed the cap you approved — when it is exhausted, the feature pauses instead of overcharging.
- Cancel/downgrade any time from the Billing page, no support email required.
5. Acceptable use
We may suspend accounts violating the above, with notice where feasible.
- No unlawful, deceptive or malicious use (spam, phishing, rights infringement)
- No attempts to bypass usage limits, security or data isolation
- No reselling of the service without written agreement
6. Data
Data processing is described in the Privacy Policy, which forms part of these terms. In short: your data stays yours, we don't train models on it, and it is fully erased on uninstall.
7. Availability
We make reasonable efforts to keep the service available, without guaranteeing uninterrupted operation. Planned maintenance is announced in-app. The service also depends on the availability of Shopify and the AI providers.
8. Intellectual property
The app, its software and marks belong to EMARKSS LTD — Lumnya and EMARKSS are trademarks of EMARKSS LTD. Your store's data and the content generated for you (answers, reports) belong to you.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid for the service in the preceding 12 months. We are not liable for indirect damages, lost profits, or data loss not caused by our gross negligence. Nothing in these terms limits liability that cannot be limited under applicable law.
10. Termination
You may terminate at any time by uninstalling the app — store data is erased per the Privacy Policy. We may terminate or suspend the service for material breach of these terms.
11. Governing law and changes
These terms are governed by the laws of England and Wales; the courts of England and Wales have exclusive jurisdiction. Material changes are announced in-app before they take effect; continued use constitutes acceptance.
